Accident At Work Case Report

Our client contacted us to make a claim for compensation for personal injuries that he sustained in an accident at work.  Our client has been walking across the warehouse at work when he was hit and crushed by a reversing JCB. 

It later transpired that the JCB driver, who was employed by the Defendant at the time of the accident, did not hold a license to drive the vehicle.

Liability for the accident was admitted by the Defendants.

Our client sustained significant and multiple injuries in the accident and underwent surgery several times.   Medical evidence was obtained from several medical disciplines.  A summary of his injuries included:- 

  • Multiple rib fractures with small haemothorax and tracheostomy

  • Abdominal injuries including liver laceration, biliary peritonitis, hernia

  • Pelvic fractures to the left and right pubic rami.

  • Fractures to his 4th and 5th metatarsal bones in his left foot

  • Minor Post Traumatic Stress Disorder 

Court Proceedings were issued in order to claim compensation for our client’s injuries and the claim settled for the sum of £43,000 before trial.
