The circumstances of the accident are as follows. At all relevant times our client was employed by the defendant and carrying out duties in the course of his employment. On the of the accident our client and two of his work colleagues had cause to use what is known as a ‘Merlo’ teleporter and man carrying basket. They were 25 feet up in the man basket which was attached to the teleporter when the basket became detached from the teleporter.
