Mr B was stationery in a bicycle lane at a set of traffic lights in Gosport Hampshire, when the lights changed to green the car positioned alongside his right hand side tried to turn left across the cycle lane Mr B’s path causing the car to collide with his bicycle and as a result caused Mr B personal injury.
Mr B instructed Hayward Baker solicitors to pursue his claim for personal injury compensation.
Hayward Baker made the claim through the insurers low value portal on-line and the allegations against the car driver (Defendant) were as follows:
“The Defendant failed to check his mirrors/blind spot before making the manoeuvre and cut across the Claimant’s path (a cycle lane) resulting in a collision with the Claimant. “
The Defendant insurers acknowledged the claim within 24 hours as per protocol and then had 15 days to respond with a decision on liability.
Seven days passed and a decision by the insurers was received and they are admitting fault for the accident.
Hayward Baker then arranged a medical appointment for Mr B with a General Practitioner Consultant who would then formulate a report on Mr B’s injuries and this report would be used tin support of his claim and enable his solicitor to make a valuation.
Once the report was received it showed that the injuries were sustained as a result of the accident. The injuries were reported as laceration and bruising injury to knee and elbow leaving scarring.
Based on the time the wounds took to heal and that the small scars were likely to be permanent the claim settled for just over £2900.00 to include a repair for the bicycle and train fair to the medical appointment.
