Accident Circumstances: Our client was a passenger in a vehicle going around Dartmouth Circus roundabout when his driver moved into another lane when it was not safe to do so and collided with another vehicle. As a result of this collision our client suffered personal injury.

Our Client’s Injuries: Seat belt related injury, lower back slipped disc, neck, shoulders and upper back pain. Injury to left hip.

What did Hayward Baker Solicitors do to help: One of our personal injury specialists Alison Spriggs who is a Fellow of the Institute of Legal Executives took on the case on a no-win-no-fee basis and sent a letter of claim to the defendant, who denied liability.

We collated evidence to prove that the accident was not our client’s fault but that of the driver of the vehicle in which our client was travelling. One piece of evidence being  a signed witness statement in support of our client’s turn of events. As liability was denied we issued court recordings and the defendant insurers instructed solicitors to act on their behalf. Fortunately we did not have to take the case to court and the defendant solicitors eventually admitted liability for the accident.

We arranged for our client to be seen by a medical expert who after examining our client formulated a medical report upon his injuries. The first consultant a General Practitioner referred our client to an Orthopaedic Consultant and a Psychologist who in turn examined our client and formulated their own  medical reports.

These reports were used to show the defendant insurers/solicitors the extent of our client’s injuries. It was these reports that were also used to value our client’s claim for personal injury compensation.

We also claimed for our client’s out of pocket expenses which we call special damages as below:

  • Travelling expenses to and from medical appointments
  • Loss of earnings due to taking time of work sick due to his injuries
  • Care and assistance for help around the home
  • Medication (e.g. pain killers)
  • Medical treatment
  • Postage and telephone call costs

Resolution: Claim settled for £25,000.00
