Our client was acting in the course of his employment as a Warehouse Operative with the Defendant employer in Grays, Essex. A colleague opened a gate in the warehouse to allow our client through. However, he then released the cord that opened the gate allowing it to swing around and hit our client in the eye. As a result, our client sustained a nasty subconjunctival haemorrhage to the right eye and was in pain for several weeks. Our client’s employer accepted their vicarious liability for the negligent act of the colleague and a settlement of nearly £3500 was agreed with their insurers before the issue of Court proceedings became necessary. Fortunately, our client made a good recovery from his accident in the workplace.
