Our client was at her place of work and was required to use the waste disposal machine but when she tried to use it the machine would not work. The insurers investigated the matter and although they did not respond within the time period set for portal cases did admit liability for the accident but on a 80/20 basis in favour of our client. The reason they were partially blaming our client was because she should not have touched the switch with wet hands but the defendant should have installed an ingress protection rated isolator.
What this mean’t was that as long as a medical report confirms that the injuries were consistent with the accident the insurers have agreed to pay our client compensation for her injuries.
While Angela sought copies of our client’s medical records from her GP and the hospital she attended at the time of the accident our client was asked to confirm the position with regard to her injury.
Once Angela was in receipt of the medical records she arranged for our client to be examined by a General Practitioner who would formulate a report upon our client’s injuries.
It would be this report that would be evidence of our client’s injuries and aid Angela in valuing the personal injury claim.
Once the report was received Angela reviewed the same and wrote to our client asking for her to read the report and if she was happy that the consultant had covered everything within the report she was to sign the approval form and return this to Angela or if she was not happy to contact Angela as soon as possible to discuss.
The report highlighted that our client had incurred travelling expenses to and from her medical appointments so Angela recorded these on our client’s out of pocket expenses schedule and duly attached this to the medical report for approval.
Our client approved both the report and out of pocket expenses claim so Angela valued the claim and forwarded copies to the insurers asking them to make an offer in settlement.
Having listened to Angela regarding the offer made by the insurers, our client accepted £4500.00 in full and final settlement of her claim.
