Our client, a hospital cleaner from Aylesbury, Buckinghamshire, suffered a nasty hand injury at his place of work when a colleague let go of a heavy door as he was pushing a trolley through it. The door did not have closing control mechanism and when it was released, it swung closed quickly trapping our client’s left hand and leading to a broken finger and ligament damage. The hospital accepted liability for the accident on the basis of their responsibility to keep the workplace safe and free from defects, and because of their vicarious liability for the negligent acts of our client’s colleague in releasing the door before he had safely passed through it. Alterations were made to the door and a settlement was agreed in the sum of £5300.00 for personal injuries and financial loss.
