On the day of the accident our client was riding his bicycle along a road in Leatherhead. The Defendant, driving a car drove out of a side street failed to stop and give-way to the Claimant who was correctly proceeding along the road. As a result the Defendant collided into our client causing the him to fall to the ground sustaining an injury. The emergency services were called and our client was taken to Epsom General Hospital.

The defendant insurers denied liability for the accident shortly after we submitted our client’s claim and therefore we had to prove not only were the injuries caused by the accident but prove that the car driver was at fault.
A medical examination with a medical expert was arranged, as we still had to prove our client’s injuries were as a result of the accident, who would examine our client and formulate a report upon his injuries. It would be this report we used to help prove our client’s injuries were as a result of the accident and aid us in valuing his claim.
The report also supported the following claim for Special Damages:
- Travel expenses to and from medical appointments
- Cost of repair to damaged bike
- Replacement helmet and jacket
We also arranged a course of physiotherapy for our client to help in his recovery.
Settlement could not be reached between the two parties and therefore Court proceedings were issued and it would be left to a Judge to decide who was at fault for the accident.
Although proceedings were issued and all preparation for Court was made the Defendant Solicitors eventually agreed and out of Court settlement with our client.
