Mrs B was driving correctly along a road in Peacehaven in East Sussex when she slowed down and stopped due to a queue of traffic in front of her. Unfortunately the vehicle behind was travelling too fast, failed to stop or steer out of the way and collided with rear of her vehicle causing her to suffer injuries to her neck, mid and lower back and headaches.
Hayward Baker took on Mrs B’s claim for compensation and received a liability decision within 3 days of lodging the claim via the low value claims portal. As liability was admitted it was a straightforward case to run all that was needed was a for Mrs B to confirm her losses (e.g travelling expenses) and to attend a medical examination with a GP Consultant who then formulate a report as to the extent of her injuries and whether they were consistent with the material accident.
The subsequent report confirmed that Mrs B’s injuries were as stated and her solicitor used this and her schedule of losses to value the claim.
The claim was then disclosed in full the the other drivers insurers and an offer was made to the insurers in settlement of the claim. After receiving a counter offer from the insurers Hayward baker negotiated further and reached a final settlement figure of just over £2,500 which included travelling expenses incurred attending her medical appointments and a claim for care which was helping her to undergo domestic tasks she could not do herself at her home.
From Hayward Baker taking on the case to Mrs b receiving her settlement cheque took 6 months.
