The reason we were alleging fault is that the supermarket, it’s servants and/or agents were negligent and/or in breach of their statutory duty in:

a) Causing or permitting the baskets to be or to become or to remain a danger and a trap by being stacked too high.

b) Failing to devise, institute or enforce any or any reasonable system of inspection which would have identified that the baskets were stacked too high and the hazard removed.

c) In the circumstances, failing to discharge your common duty of care to our client in breach of the Occupiers’ Liability Act 1957.

After a period of investigation the insurers informed Hayward Baker that liability was admitted on behalf of their insured subject to medical evidence.

This mean’t that as long as the medical report confirmed that our client’s injuries were as a result of the accident then they will pay her compensation.

Angela duly arranged for our client to be examined by a medical expert, namely a General Practitioner who after examining our client would formulate a report upon our client’s injuries. It would be this report that would used as medical evidence to prove our client’s injuries and to value her claim for both injury and financial losses.

Upon receipt the medical report was reviewed by Angela who subsequently sent the report and a schedule of out of pocket expenses to our client for approval.

The out of pocket expenses were mentioned in the medical report and were as follows:

  • Travel expenses to and from hospital appointments
  • care and assistance around the home with domestic and personal duties
  • Postage and telephone costs

Our client was happy with her expenses schedule and medical report so signed and returned the authorities for Angela to disclose the claim and negotiate an offer in settlement.
