Our elderly retired client was visiting a local Garden Centre in Towcester, Northamptonshire when she slipped and fell as a result of stepping on a child’s toy that had fallen from the shelving onto the floor of the aisle. The fall caused a painful fracture of the top of the femur and a lengthy recovery period for our client. Fortunately, the Garden Centre’s insurers accepted on behalf of their policyholder that the shelves had not been properly stacked and no adequate system of inspection was in place that might have allowed the toy to have been spotted and removed from the floor before the accident. Our team negotiated a settlement in the sum of approximately £16,850 for our grateful client without the need to issue Court proceedings.
