Our mechanic client was replacing a wheel bearing at his place of work.
To complete this task our client needed to use a breaker bar tool. On this occasion however, the breaker bar would not correctly complete the work so our client was asked to use a different pole tool.
This tool snapped the breaker bar and ultimately caused a jolt which affected our client’s back and caused an injury.

Having investigated our client’s claim the Defendant insurers didn’t accept liability, which meant that Susan now had to collect evidence to prove that they were responsible.
The Defendant insurers stated that they carried out a suitable risk assessment and provided the correct tool for the job, and that our client was trained to use the bearing removal tool provided.
However, evidence was gathered by Susan, which proved that our client was told to use the wrong tool and that there was no proper tool for the job available (an angle wrench). It was also proved that he was not trained to use an angle wrench.
Hayward Baker were planning on taking this claim to Court but the insurers then accepted liability for the accident without the need of a Trial.
Once Susan had sufficient medical evidence and full details of all financial losses, she went on to negotiate a fair and correct settlement.
This covered compensation for our client’s injuries and an amount for out of pocket expenses to include loss of earnings, care and assistance and a small amount for phone calls and letters.
