Grandmother slips while taking kids to see Santa in Clacton-on-Sea and receives compensation for her injuries
Our client was a lawful visitor to a garden centre in Essex which had a Santa’s Grotto and she had taken her grandchildren to see Father Christmas. As she left the store she slipped and tripped on some water on the floor. As a result of the fall our client sustained injury. She was informed by the store that the cause of the water was a leak in the store roof.
Client’s Injuries: Injury to right wrist, laceration to her chin, headaches and an injury to her mouth.
What did Hayward Baker Solicitors do to help: One of our personal injury specialists Gary Lee who is a Chartered legal Executive took on the case on a no-win-no-fee basis and sent a letter of claim to the defendant, who admitted liability.
A medical appointment was arranged for our client to be examined by a medical expert after which the expert formulated a report upon our client’s injuries. It was this report that was used as evidence to show our client’s injuries to the defendant insurers and enabled Gary to value our client’s injury compensation and associated losses. Travel expenses, painkillers and a small amount in postage and telephone costs was claimed for as part of our client’s Out of Pocket Expenses (Special Damages).
As our client had a scar caused by a laceration to her chin, photo’s of the scar were sought to show the defendant insurers the extent of the scarring. A copy of this picture was then sent to the medical expert who formulated the original medical report and Gary asked this expert to comment on the scarring as to whether it would improve in time or would stay the same.
As liability was not in dispute once all the medical evidence was gathered Hayward Baker disclosed the case in full the the defendant insurers asking that they now make an offer.
