Lady passenger in car collision receives over £5000 in damages

Our client was a passenger in her husbands car when the defendant did a u-turn in the road, hit the kerb then at speed reversed and collided with our client’s vehicle. As a result of the collision our client suffered personal injury and loss.

Our Client’s Injuries

As a result of the traffic collision our client suffered  a soft tissue injury to her neck, shoulders and back. She had ringing in her ears. A existing plaster cast on our client’s arm was moved by the force of the accident causing a blood flow problem to her hand and wrist and therefore had to be removed and reset.

How did Hayward Baker help?

We took on the claim on a No Win No Fee basis and from the very  beginning we had to investigate who the driver and vehicle insurer was as the driver drove off without exchanging details and had also hired the van that he was using at the time of the collision. Once the identity of the correct insurer was identified and the name of the driver (which we obtained from the police report as the police got the drivers name from the hire company) we wrote to the defendant and his insurers blaming him for the accident.

Liability was a long time in coming but was eventually conceded by the defendant insurer.

We instructed an Orthopaedic Consultant to examine our client who then formulated a report upon her injuries. It was this report that was used to prove our client’s injures were as a result of the accident and to value her claim for compensation and associated losses.

We negotiated with the defendant insurers a settlement figure of £5,500 to include travel expenses to and from medical appointments, vehicle hire and repair  costs and prescription charges.
