Man falls due to defect on train station and receives £7400.00 in compensation

Mr D was due to catch a train at Horsley station but as he was walking up to the platform he fell due to a defect in the platform surface (i.e. a deep indentation).

When Mr D tripped on the defect he fell onto his back causing injury to his hip and knees.

Liability was admitted when South West Trains  put forward a Part 36 offer on liability on a one and two thirds basis in our client’s favour.

Court proceedings had also been issued due to limitation approaching.

The offer made by the Defendants solicitors was accepted at £11134.25 on a 100% basis but due to the 3 part split Mr D received £7422.83 in compensation for his injuries.
