Our client was employed as a Die Caster and to start the Die Casting machine he had to stand on a staging platform. As he was checking the switches on the machine his left foot went down a gap in the staging platform and he fell backwards down 3 steps hitting his head and shoulder on a computer monitor and then fell to the floor.
The staging platform is in two parts and separates to assist cleaning but this had not been put back together correctly which is why there was a gap.
As a result of the accident our client suffered injury.
Our Client’s Injuries:
Our client was knocked unconscious and suffered an injury to his right shoulder, numbness in his hands and stress and pain in his neck.
What Hayward Baker did to help:
Alison Spriggs who is one of our senior personal injury claim specialists confirmed to our client that Hayward Baker Solicitors would act on his behalf for his accident at work claim.
Alison ran the claim through the low value personal injury claims portal. The Defendant insurers acknowledged the claim and after a short period of investigation notified Alison that liability was not in dispute.
Alison then arranged for our client to be examined by two medical experts, the first being an Accident and Emergency Consultant and the second a Consultant Neurologist. It was the reports from these two medical experts that proved our client’s injuries, enabled Alison to arrange the relevant treatment to aid our client’s recovery and for her to be able to value our client’s claim for compensation.
The medical report suggested a number of out of pocket expenses claims (special damages) in addition to the general damages which is compensation for our client’s injuries.
Alison formulated a schedule of special damages to contain the following:
- Travel expenses to and from medical appointments
- Loss earnings
- Medical expenses
Our client was awarded £12,765.00 in damages
