A recently settled case reminded us that any occupier of premises has a duty to keep those premises free from any defects that may cause injury to a lawful visitor.
Our client was visiting his GP’s surgery in Leigh-on-Sea, Essex. As he entered the surgery he slipped on a wet and heavily worn mat. This caused him to fall and sustain a nasty soft tissue injury to his right knee. Our client had the presence of mind to obtain photographs of the mat in question and these clearly showed it was worn and in poor condition. The surgery’s insurers accepted the mat was in a dangerous state and created a foreseeable risk of injury and a settlement in relation to this slip and trip claim was agreed in the sum of £2,700.
