Pedestrian hit by car when crossing a road is awarded compensation for injuries

Our client was walking along a road in Hampshire. As our client crossed the road the Defendant turned right from a side road and drove into a collision with our client. As a result of the accident our client has sustained injury loss and damage.

  • Broken right ankle.
  • Laceration to right index finger.
  • Bruising and swelling to left ankle and foot.
  • Bruising to right foot.
  • Bruising and cuts to right hand.
  • Broken filling.
  • Abdominal pain.
  • Bruised and swollen left thigh.
  • Bruised and swollen inner right calf.

How Hayward Baker helped:

We took on this claim on a No Win No Fee basis and ran it through the low value insurers online portal and our client signed a Conditional Fee Agreement (CFA) with our firm.

Liability was admitted by the Defendant insurers which meant  that if we could prove our client;s injuries the insurers would pay our clint compensation.

To achieve this we were going to obtain a medical report from a medical expert. However before we could arrange this the insurers made a pre-medical offer to settle our client’s claim.

A pre-medical offer is made in full and final settlement of the personal injury claim. Therefore, if accepted by our client, Hayward Baker would  not be able to obtain a medical report fully detailing our client’s  injuries and our client would not be able to return to the insurer at a later date for further compensation.

Our client had a period of time to think about the offer after which if the offer was not accepted it would be removed.

Hayward Baker Advice

It is difficult for Hayward Baker to advise ou client upon the reasonableness of this offer without the medical evidence to confirm the exact nature and duration of the injuries that they have sustained.

It may be that the claim is worth more than the current offer once the medical report is received however there is no guarantee and it could be worth less than the current offer.

Should our client accept the offer then the case would come to an end.

Resolution:

Our client accepted the offer and was awarded £7,000.00 in compensation for her injuries.
