Ms Z was travelling as a passenger in a vehicle on the A65 in Kirkby and her driver had just stopped the car due to a queue of traffic when the driver behind failed to stop and collided into the rear of the vehicle in which she was travelling. as a result of the accident Ms Z suffered a whiplash injury to her neck, shoulder and back.
Ms a instructed Hayward Baker Personal Injury Solicitors to act for her in her claim for personal injury compensation. Ms Z’s solicitor stated her claim via the low value insurers portal on the 3rd September 2015 and received notification that liability was admitted on the 11 September 2015 only 8 days later.
Hayward Baker now arranged a medical appointment for Ms Z with a General Practitioner who would examine her and write a report upon her injuries. It will be this report that would be used as evidence of her injuries and enable her solicitor to value the claim.
An appointment was quickly arranged for the beginning of October 2015 which was duly attended by Ms Z.
Once the medical report was received by her solicitor a copy was sent to Ms Z along with a copy of her updated out of pocket expenses schedule for her approval. The report confirmed that the injuries that she had sustained were consistent with the circumstances and no further treatment was required.
Ms Z approved both the report and her schedule of losses and sent the signed authorities back to her solicitor. Hayward Baker then put forward an offer for settlement to the defendant insurers as agreed by Ms Z for £2900.00 which unfortunately was rejected as being to high so a second offer was sent for just over £2460.00 which was accepted by the insurers.
