Our client was a rear seat passenger travelling along a road in the West Midlands. The vehicle she was in came to a stop waiting to join a junction when suddenly and without warning the defendants vehicle reversed into the drivers side of the car in which our client was seated. As a result of the collision our client suffered injury and loss.
Our Client’s Injuries:
Whiplash/soft tissue injury to neck and right shoulder.
How did Hayward Baker help:
We took on the case on a No Win No Fee basis and stated the claim to the defendant insurers via the online personal injury insurers on-line portal.
The insurers acknowledged the claim and soon afterwards contacted us to say that liability was admitted for the accident subject to medical evidence. This meant that as long as a medical report shows that the injuries were caused by the accident then the insurers would pay her compensation.
We arranged numerous medical appointments for our client to be examined by a medical expert and these included a General Practitioner and an Orthopedic Surgeon. The report formulated by all of the experts confirmed the injuries were caused by he accident and advised what treatment was required to aid our client’s recovery.
From the medical reports we arranged for our client to seek treatment from a physiotherapist and undergo a course of acupuncture. The medical reports also highlighted a number of items to be added to our client’s Out of Pocket Expenses Schedule (Special Damages) such ase:
- Travel Expenses to and from medical appointments
- care and Assistance around the home to help with domestic and personal duties
- 6 sessions of physiotherapy
- 13 sessions of Acupuncture
- Medical expenses (e.g. Ibuprofen, Paracetamol, Tiger Balm and Olbas Oil)
Once our client had confirmed she was happy with her medical reports and special damages schedule she signed the authorities for us to release the medical reports and schedule to the defendant insurers and gave us permission to negotiate settlement of her claim.
Numerous offers were made by us and the insurers and after some heavy negotiating we managed to settle our client’s claim for £5,000.00.
