Our client was employed by the defendant as a security engineer but on the day of the accident he was told to attend a local school and help the heating division to lay some large heating pipes. This task was not part of our client’s normal duties and as he was walking backwards pulling a pipe he stepped onto another pipe and fell forward causing him to suffer injury.
Our Client’s Injuries:
Torn triceps tendon requiring surgery.
How Hayward Baker helped:
One of our senior lawyers took on the claim on a No Win No Fee Basis and stated the claim via the online personal injury claims portal. The Defendant insurers acknowledged the claim and liability was admitted shortly after the defendant insurers investigated the claim.
As liability was admitted we arranged for our client to be medically examined by an Orthopaedic Consultant and as long as the experts medical report confirms that the injuries were as a result of the accident then the insurers will pay our client compensation.
The subsequent medical report did prove our client’s injuries and also highlighted a number of out of pocket expenses (Special Damages) that our client could claim for.
Our client’s special damages consisted of:
- Loss of earnings
- Numerous journeys to and from hospital for medical appointments
- Care and assistance around the home for help with domestic duties
- Private Health care expenses
- Medical expenses to include painkillers and prescription charges
Once our client had all the surgery he required and physiotherapy he signed an authority so we could disclose his medical report and special damages schedule to the defendant insurers and ask that they make an offer in settlement of his claim.
Numerous offers were made and received and eventually we got to a figure that were agreed by both sides.
We settled our client’s claim for just over £13,000.
