A recent case our specialist trip team dealt with highlighted the need for occupiers of premises to take great care to remove dangers and defects.
As our client approached the entrance to a large store in Gosport, Hampshire, she tripped and fell as a result of catching her foot on a protruding concrete stump in the ground. This was a broken bollard/post and although the broken part had been removed, no thought had been given to the remaining stump and the tripping hazard this created. As a result of falling, our client fractured her left humerus where the bone meets the shoulder joint causing a painful injury and a lengthy period of recovery. Our specialist team had to issue Court proceedings against the occupiers of the premises before a settlement of £11,000 was agreed to compensate our client’s pain and suffering and financial losses.
