Ms B and Ms D were travelling with Easyjet from Rhodes to Milan on 28 July 2018. The plane which was scheduled to operate their flight was delayed on previous sectors and Easyjet only allowed on average just 45 minutes to turn the aircraft around leaving no room to make up any delay for lost time. These short delays meant that the crew could no longer operate our Clients’ flight as they would have done their hours for the day and so the flight was delayed over night by 16 hours and 27 minutes. Our Clients were forced to sleep on the floor of the airport over night with no food or basic necessities provided by the airline. They could not even buy anything for themselves as all the outlet shops were shut by the time they were told that the flight would not operate that day.
Hayward Baker were instructed to bring a claim for compensation under EU Regulation 261/2004. Easyjet defended the claim all the way to a hearing and instructed a barrister to represent them.
