Our client who is a teenager was cycling his bicycle in London when the Defendant opened his car door into our clients path causing a collision. As a result of the collision our client fell to the floor and suffered injury.
Our Client’s Injuries:
Our client suffered a fracture of the right eye socket, double vision, anxiety, cuts, lacerations and bruises to right side of body.
What Hayward Baker did to help:
One of our Personal Injury Specialists Alison Spriggs made the claim through the Low Value Personal Injury Claims Portal.
As our client was under the age of 18 at the time of the accident his Mother acted as his Litigation Friend. A Litigation Friend is someone appointed to make decisions about a court case for either an adult who lacks the mental capacity to manage their own court case either with or without a solicitor or a child.
After investigating our client’s claim, the Defendant insurers admitted liability for the accident on behalf of their insured.
Alison then obtained medical evidence to support our client’s injuries by arranging a medical appointment with a number of medical experts:
- Paediatric Orthopaedic Surgeon
The medical reports formulated by the above medical experts confirmed that the injuries were as a result of the accident.
Our client underwent reconstruction surgery to his right eye socket and a course of Cognitive Behavioural Therapy (CBT) to deal with the anxiety issue.
Once our client was happy with his treatment and final prognosis from the relevant medical experts he authorised Alison to disclose his claim in full to the Defendant insurers asking them to make an offer in settlement of his claim.
Negotiation and Valuation:
Once Alison received the signed authorities from our client she used the medical reports to value our client’s claim for damages and associated losses.
The settlement amount that Alison negotiated for our client with the Defendant insurers was £15,000.00
