Our Client was travelling from London Gatwick to Burgas airport in Bulgaria with TUI Airways.
The flight was delayed over 3 hours. Our Client instructed Hayward Baker to pursue his claim for compensation under EU Regulation 261/2004. Under the regulation our Client was able to bring a potential claim for 400 euros.
Hayward Baker wrote to TUI asking for our Client’s compensation but they refused saying that the flight was delayed due to “Air Traffic Management” who restricted the flights movements. We asked for more information about the alleged decisions but the airline refused to cooperate.
As a result formal court action was taken and the case went to a full trial.
It came to light that the flight had been subject to an earlier delay due to a routine technical issue which would not give the airline a defence to the claim. Hayward Baker argued that it was not an Air Traffic restriction at the airport but instead the earlier technical issue caused TUI to miss their allocated flight slot (or take off time) and so they had to wait for another one and that TUI were just hiding behind this as an excuse not to pay compensation.
The Judge agreed with Hayward Baker and awarded our Client £340.97.
