Hayward Baker represented Mr Grant in a claim for compensation under European Regulation 261/2004 at the Wandsworth County Court. Mr Grant sought 400 euros from Turkish Airlines. On 10 November 2018 Mr Grant was flying with Turkish Airlines from London to Istanbul and then onto Ecran Airport in Northern Cyprus. The first flight was delayed by around 40 minutes which caused our Client to miss his onward flight and our Client was rebooked onto another flight arriving several hours later at around 01:20.
Turkish Airlines refused to pay compensation stating that the delay was due to extraordinary circumstances which no reasonable measures could have avoided and instructed solicitors to defend the claim.
At trial the Claimant produced evidence showing that the delay could have been reduced by over 3 hours if the Defendant had rebooked our Client onto a different flight in Istanbul. The trial Judge agreed and found that a blanket statement by the airline saying that their normal practice is to rebook passengers onto the quickest alternative flight was not sufficient to say whether they had indeed tried to do so in this case or not.
