Our client was employed as a lorry driver with the Defendant in Kettering, Northamptonshire. In the course of his employment, our client was asked to make a delivery of bricks to a property in Aldwincle. He was provided with an electric pump truck to move the bricks but was not provided with any instruction or training upon how to use it. As our client was attempting to move the pallet of bricks with the pump truck, the pallet broke and the pump truck struck our clients’ right knee causing a rupture. An enquiry revealed the pump truck had been overloaded and the excessive weight had caused the pallet to break when it was lifted.
The Defendant’s insurers accepted their insured had failed to provide any adequate health and safety training and had failed to carry out any proper risk assessment of the task they had asked our client to do in the course of his employment. In so doing, they had exposed our client to a foreseeable risk of injury. The insurers accepted liability on behalf of their insured and a negotiated of just over £12,600 was agreed in damages by way of compensation for personal injuries and financial losses.
