Ms Smikle and her family were travelling with Easyjet from London Gatwick to Madeira on 27 May 2019. The flight ended up being delayed by 34 hours and 10 minutes.
Ms Smikle instructed Hayward Baker to bring a claim for compensation under EU Regulation 261/2004 for £350 for each passenger.
Easyjet denied liability stating that the flight was delayed due to adverse weather conditions at Madeira as the flight would not be able to safely land and they operated the flight as soon as they could after conditions improved.
We looked into this denial and investigated the flight disruption at Madeira on the date in question and could see no other flights with significant delays. As such small claim court proceedings were commenced and the claim ultimately went to trial at the Southampton County Court.
District Judge Markland found in favour of the passengers. In his ruling he held that:
“On this occasion I do not consider that the Defendant have made out their defence as the record demonstrates that flights continued to land at Madeira airport the 27th May 2019 including 320 aircraft”
The Judge awarded £1,400 in compensation to our Clients.
